    This was an interesting episode, although I think you should tread very carefully when discussing what (if anything) one should say to the authorities after a shooting. The episode also falls into the trap of over-estimating the importance of convincing cops of anything.

    Whew, many thanks Jacob and Brian – lot’s of helpful information a suggestions to prepare oneself BEFORE the hour of need. And while the title, “Phrases and Commands” is provocative enough, upon reflection and in your discussion, we should also be mindful of scenarios and possible/appropriate responses.
    And while the following is my first draft, I welcome your comments:

    If possible, RECORD the activity
    – If in your car and you have a DashCam, orient camera in the best position
    – If possible, RECORD AUDIO using your electronic watch (iWatch App, etc).
    – Or have a 3rd party record audio/video, etc

    DON’T FREEZE – BREATHE/THINK/ANTICIPATE/RECALL SCENARIOS BELOW

    BE ALERT and AWARE, notice and be able to recall most relevant elements as:
    – Scene
    – People
    – Age/Height/Body Characteristics
    – Faces/Features
    – Skin/Marks/Tattoos
    – Clothing
    – Weapon/s
    – Facial/Gestures
    – Body Language
    – Words/Tone/Infliction/Loudness
    – Perspective of Parties
    – Activities/Actions
    – Reactions/Intent/Ambiguity…
    – Conflict
    – Threat
    – Infraction
    – Escalation

    BUT be careful not to UNNECESSARILY escalate the situation yourself or those in your company

    Obviously know when to put your hand/body position in a DOMINANT or PASSIVE posture and that it cues to the adversary

    Knowing WHEN to/not to ESCALATE based on NECESSARY LEVEL OF FORCE is CRITICAL as:
    – Posturing an ACTION/RESPONSE
    – DEFENSIVE/OFFENSIVE
    – Use of Non-Lethal Force
    – ASSAULT/BATTERY
    – Hand NEAR WEAPON
    – Hand ON WEAPON
    – Hand in LOW READY…
    – Use of Deadly Force/Possible Permanent Body Damage

    Consider when it is appropriate to use COMMANDS

    DO NOT just say “STOP!” Instead consider what you need person TO DO or NOT DO.

    Even “FREEZE/DO NOT MOVE” is better

    If and ONLY when appropriate, say “DO NOT GET ANY CLOSER TO ME,” with open hands waving back and forth

    Or, “GET AWAY FROM ME” and hand gesture open palms pushing away

    Instead, if necessary say “STAY AWAY FROM ME, I DON’T WANT” (a fight, etc)

    In almost all situations, AVOID making potentially threatening statements as, “I will take measures to defend myself,” or an even more assertive/aggressive statement

    Only if threatened and you do have a method to defend yourself should you add, “IF NECESSARY, I WILL DEFEND MYSELF”

    Especially worse would be making a movement or gesture toward (or perceive to be) a weapon, potentially creating the APPEARANCE OF ESCALATION

    Voice TONE, PITCH, LOUDNESS and BODY POSTURE and GESTURES all matter!

    Remember, EVERYTHING you say to 911 WILL BE RECORDED

    To police when you are carrying, hands raised and open, announce you are carrying but do NOT move hands or do anything unless directed by police, confirm you will be complying with police order/instructions, move very slowly

    To police when pulled over:
    – Keep hands on steering wheel or raised/showing if situation required
    – Do not grab for license, registration, move hands/body unless instructed to do so (unless you can easily grab wallet in hands before stopping car
    – Be non-aggressive/non-assertive and be compliant and vulnerable

    To police:
    – Sorry Officer, What Did I Do/How Can I Help You?
    – Please help me understand…
    – Am I being detained
    – Am I under arrest
    – I NEED TO TALK WITH MY REPRESENTATIVE BEFORE I GIVE A DETAILED STATEMENT (in non-aggressive tone)
    – I WISH TO ASSERT MY 5th AMENDMENT RIGHTS BEFORE RESPONDING TO QUESTIONS
    – If/once you have been read your Miranda Rights, understand you must NEVER think it is okay to volunteer further information at that time
