If someone is on your porch in the process of stealing a package, can I go out side and fire 2 real 9mm rounds into the ground (not aimed a them, shooting not in their direction) without getting arrested? It’s just to scare them so they don’t come back. I live in Ohio. Thanks
Just pulling your gun out of your holster can be viewed as deadly force. Usually, deadly force is only warranted when life is in some sort of danger. Granted there are exceptions to this rule, but that is the general consensus across the United States. Also, shooting into the ground is generally not a good idea either, as it can be dangerous. A ricochet still retains enough velocity to do damage to a person or property. Even if it’s not in their direction, a bullet’s trajectory can change when it bounces off something, and the shooter has no control over which direction it goes.
Your best course of action in this case would be to call the police and give them as much information on the thief as you can. For example, what they were wearing, what kind of car they were driving, etc., can all be useful info.
